Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Business:
FrostPaws, operated by NorthBridge Global LLC, with its principal office at 30 N Gould St Ste R, Sheridan, WY 82801, United States.

Consumer:
Any natural person acting for purposes outside their trade, business, craft, or profession who enters into a distance contract with the Business.

Distance Contract:
Any agreement concluded between the Business and the Consumer under an organized system for distance sales, where exclusive use is made of one or more means of distance communication up to and including the moment the agreement is concluded.

Withdrawal Period / Right of Withdrawal:
The period of 30 days during which the Consumer may request a return in accordance with these Terms and Conditions and the Return and Refund Policy.

Durable Medium:
Any tool that enables the Consumer or the Business to store information addressed personally to them in a way that allows future consultation and unchanged reproduction, such as email.

Website:
The FrostPaws website and all associated pages, content, features, tools, products, and services.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by FrostPaws and to every distance contract concluded between FrostPaws and the Consumer.

Before the contract is concluded, the text of these Terms and Conditions will be made available to the Consumer. If this is not reasonably possible, FrostPaws will indicate where the Terms and Conditions can be accessed electronically and that they will be sent free of charge upon request.

If specific product or promotional terms apply in addition to these Terms and Conditions, those terms will also apply. In the event of any conflict, the provision most favorable to the Consumer will prevail.

Any deviations from these Terms and Conditions are only valid if expressly agreed in writing or by email.

Article 4 – Use of the Website

By using the Website, the Consumer confirms that they:

• are at least 18 years old, or
• have permission from a parent or legal guardian.

The Website may not be used for:

• unlawful purposes
• activities contrary to applicable laws or regulations
• transmitting viruses, malware, or harmful software
• copying or commercially exploiting content without permission

In the event of misuse, FrostPaws reserves the right to block access to the Website and, where necessary, take legal action.

Article 5 – Offers and Product Information

FrostPaws takes reasonable care to ensure that all information on the Website is accurate. However, errors or omissions may occur.

Product descriptions, images, and specifications are intended to provide as accurate a representation as possible.

All offers are non-binding and valid while supplies last. FrostPaws is not bound by obvious errors, mistakes, or misprints.

Article 6 – Formation of the Agreement

The agreement is concluded once the Consumer has fully completed the checkout process and payment has been successfully received.

After placing an order, the Consumer will receive an order confirmation by email. FrostPaws reserves the right to refuse or cancel orders in cases including, but not limited to:

• suspected fraud
• incorrect or incomplete information
• unusual order quantities
• payment or security issues

If an order is cancelled after payment, any amount paid will be refunded.

Article 7 – Prices and Payment

All prices shown on the Website are listed in the applicable currency displayed at checkout and include taxes where required, unless stated otherwise.

For this return policy framework, refund amounts are processed in CAD, where applicable.

Payment must be made through the payment methods offered on the Website. The Consumer is responsible for providing accurate billing and payment information.

Article 8 – Delivery and Shipping

FrostPaws sells and ships to customers in Canada.

Orders are generally processed within 1–2 business days. Delivery times shown on the Website are estimates only and are not guaranteed deadlines.

The risk of loss or damage to products remains with FrostPaws until the products are delivered to the Consumer.

Article 9 – Right of Withdrawal, Returns, Refunds, and Changes

The Consumer has the right to request a return within 30 days of receiving the order.

Returns are accepted for eligible new products only. Returned items must be unused, unworn, returned in their original condition, and include the original packaging.

Used products, worn products, or products that are no longer in new condition are not eligible for return.

Eligible returns may be made for both defective and non-defective products.

Returns must be sent back by mail.

The customer is responsible for the return shipping label and return shipping cost, unless otherwise required by law or unless the item arrived damaged, defective, or incorrect.

FrostPaws does not charge a restocking fee or other return provisioning fee for eligible returns.

Refunds are processed within 7 days after the returned item has been received and approved.

FrostPaws also accepts changes in accordance with the Return and Refund Policy.

The full conditions, exceptions, and procedures for returns, refunds, and changes are set out in the FrostPaws Return and Refund Policy. That policy forms an integral part of these Terms and Conditions.

Article 10 – Third-Party Services

The FrostPaws webshop is hosted by Shopify Inc. FrostPaws may also use third-party services, including payment providers, shipping partners, logistics companies, and analytics tools.

FrostPaws is not liable for interruptions, delays, or damage caused solely by external third-party services beyond its reasonable control. For information on how personal data is processed by third parties, please refer to the Privacy Policy.

Article 11 – Intellectual Property

All intellectual property rights relating to the Website and its content are owned by FrostPaws or its licensors.

Without prior written consent, it is not permitted to copy, reproduce, publish, modify, or commercially use any content from the Website.

Article 12 – Liability

To the fullest extent permitted by applicable law, FrostPaws shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits.

If FrostPaws is found liable for any damage, that liability will be limited to the invoice value of the relevant order, unless otherwise required by law.

Article 13 – Indemnification

The Consumer agrees to indemnify and hold FrostPaws harmless from any claims, damages, or liabilities arising from misuse of the Website or violation of these Terms and Conditions.

Article 14 – Complaints

Complaints must be submitted as soon as possible, clearly and fully described, via:

FrostPaws aims to respond to complaints within 14 days.

Article 15 – Governing Law and Competent Court

These Terms and Conditions and any agreement between FrostPaws and the Consumer are governed by the laws applicable in the jurisdiction of the Business, without prejudice to any mandatory consumer protection rights that may apply under the laws of the Consumer’s place of residence.

Any disputes shall be submitted to the competent court with jurisdiction under applicable law.

Article 16 – Amendments

FrostPaws reserves the right to amend these Terms and Conditions at any time. The most current version will always be available on the Website.
